$510,000 for Trench Collapse
The crushing weight of hundreds of pounds of earth can cause severe injuries. Our client experienced this first hand when a trench collapse covered him in dirt up to his chest causing injuries to his neck, low back and knee. Our client's supervisor told him to get into the trench even though it was known to be unsafe. This was a problem in the case becuase the law did not allow recovery against the employer for negligence. For this reason, we needed an alternative avenue to recover our client's demages. We investigated why the trench collapsed in the first place, which led us to the engineering firm that designed the trench. We found that the engineering firm designed the trench to make shoring the trench impossible, creating the dangerous condition that led to the trench collapse and our client's injuries.
Lawsuits against design engineers are difficult because the engineers argue the injury was caused by the way the work was done, not with their design. We hired experts to evaluate the design of the trench, and these experts supported our case - engineering firm created a dangerous condition and it was foreseable that the condition would cause injury.
We were able to negotiate a settlement for nearly all available insurance from engineering firm. We are happy we could make a positive impact on our client's life.
