  • Workers’ Compensation Benefits

Workers compensation is an insurance benefit you earned through employment.  It is not a handout, and it is not a lawsuit against your employer.  It is a claim against an insurance company for benefits owed to you. 

If you are injured on the job, the workers compensation insurance company owes you three benefits under the law:

1.    Medical care.  The insurance company must pay for the medical care necessary to cure your work injuries.
 
2.    Temporary wage replacement.  These are called Temporary Total Disability (TTD) payments.  You have a right to weekly payments while you are treating and unable to work.
 

3.    Permanent injury payments.  After you received the necessary medical care and reached maximum medical improvement (MMI), the insurance company owes you money for your permanent injury.  There are three types of permanent injury benefits:
 

·       Permanent Total Disability (PTD): If you are unable to return to any job because of your permanent injuries, you are owed PTD payments, which are 2/3 of your average weekly wage for the rest of your life. 

·       Permanent Partial Disability (PPD): If you are able to return to work, you are owed a lump sum PPD payment, which depends on the impairment rating determined by the judge.  

·       Death Benefit: If you die as a result of your work injuries, your surviving spouse, or minor children, are entitled to a death benefit, which equals 2/3 of your average weekly wage until minor children reach 18, or the remainder of your surviving spouses life.
