You are entitled to medical treatment and care from work comp to cure and relieve the effects of your injury. This includes all costs for authorized medical treatment, prescriptions, and medical devices. There is no out of pocket costs to you through deductibles, co-pays or otherwise.

Some important aspects of workers’ compensation medical care are:

Employer/Insurer’s often do not honor their obligations

Unfortunately, work comp insurers and employers do not always honor their obligation to provide medical care.  They often deny referrals to specialist, or deny treatment all together claiming the medical condition is a pre-existing injury.  If this happens, you need to hire an experienced workers’ compensation attorney.

Employer/Insurer’s choose your doctor

Another difficulty with Missouri workers’ compensation law is that the employer/insurer has the right to select the treating physicians.  This means you may be required to treat with a doctor you would not choose otherwise to provide care.

Location of Medical Treatment

The employer/insurer can require you to travel for your medical treatment outside of the area that is your principal place of employment.  In that case, the employer is required to pay your necessary and reasonable expenses of travel.  However, the employer/insurer is not required to pay transportation costs of more than 250 miles each way from the place of treatment.

If you reside outside of Missouri, the employer/insurer may select a treatment location within 100 miles of your residence, place of injury, or place of hire by the employer.

Medical examinations and evaluations

The employer/insurer can require that you submit to “reasonable” medical and vocational evaluations.  This means the employer can require that you go see a doctor who will not treat you but will give an opinion regarding the nature, extent, and/or cause of your injuries, or a vocational expert who will give an opinion regarding whether you can return to work.  

There are limits to what is a “reasonable” evaluation.  You should talk to an experienced workers’ compensation attorney if you have concerns about an evaluation that has been scheduled.
